1. Agreement to terms

By accessing or using Buganalyst ("Service"), including the website, dashboard, embeddable widget, and API, you agree to be bound by these Terms and Conditions. If you do not agree, do not use the Service. We may update these terms from time to time; continued use after changes constitutes acceptance.

2. Description of service

Buganalyst provides a bug report and feedback widget that you can embed on your websites or applications. The Service includes account registration, widget configuration, storage and delivery of bug reports (e.g. to Slack or Trello), and related dashboard and API features. Specific features and limits depend on your plan (Free, Pro, Team, or as otherwise described on our pricing page).

3. Account and eligibility

You must provide accurate information when creating an account and keep it up to date. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. You must be at least 18 years old (or the age of majority in your jurisdiction) and have the authority to bind your organization if you are acting on its behalf.

4. Acceptable use

You agree not to use the Service to: (a) violate any applicable law or third-party rights; (b) collect or submit personal data without proper consent or legal basis; (c) transmit malware, spam, or harmful content; (d) attempt to gain unauthorized access to our or others' systems or data; (e) overload or disrupt the Service; or (f) use the Service for any illegal or fraudulent purpose. We may suspend or terminate accounts that we reasonably believe violate these terms.

5. Your data and privacy

You retain ownership of the data you submit (e.g. bug reports, widget configuration). You grant us the rights necessary to operate the Service, including storing, processing, and transmitting data to third-party services you configure (such as Slack or Trello). Our collection and use of personal data are described in our Privacy Policy. You are responsible for ensuring that your use of the widget and the data you collect comply with applicable privacy laws and that you have appropriate consent from end users where required.

6. Paid plans and billing

Paid plans (e.g. Pro, Team) may be offered and billed through us or a third-party payment provider (such as Lemon Squeezy). Fees are as stated at the time of purchase. Subscriptions typically renew automatically unless cancelled before the renewal date. Refunds are handled according to our refund policy or the payment provider's terms. We may change fees with reasonable notice; continued use after a fee increase constitutes acceptance.

7. Intellectual property

We own the Service, including the software, design, branding, and documentation. We grant you a limited, non-exclusive, non-transferable license to use the Service in accordance with these terms. You may not copy, modify, reverse-engineer, or create derivative works of the Service except as expressly permitted (e.g. embedding the widget as provided).

8. Disclaimers

The Service is provided "as is" and "as available." We disclaim all warranties, express or implied, including merchantability and fitness for a particular purpose. We do not guarantee uninterrupted or error-free operation. You use the Service at your own risk.

9. Limitation of liability

To the maximum extent permitted by law, Buganalyst and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill, arising from your use of the Service. Our total liability for any claims arising from these terms or the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim (or one hundred dollars if greater).

10. Indemnification

You agree to indemnify and hold harmless Buganalyst and its affiliates from any claims, damages, or expenses (including reasonable legal fees) arising from your use of the Service, your violation of these terms, or your violation of any third-party rights.

11. Termination

You may stop using the Service and close your account at any time. We may suspend or terminate your access if you breach these terms or for other operational or legal reasons, with or without notice where permitted. Upon termination, your right to use the Service ceases. Provisions that by their nature should survive (e.g. disclaimers, limitation of liability, indemnification) will survive.

12. General

These terms constitute the entire agreement between you and Buganalyst regarding the Service. If any provision is held unenforceable, the remaining provisions remain in effect. Our failure to enforce a right does not waive that right. These terms are governed by the laws of the jurisdiction in which we operate, without regard to conflict of law principles.
